    Data Controller

The controller of personal data is:

    DEFENSAR Aleksander Kubiak

    ul. Zamkowa 20A/21

    83-110 Tczew, Poland

    NIP/VAT: PL5562789202

(hereinafter referred to as the "Controller").

For any matters related to personal data protection, you can contact us at:
    [email protected]

    Where the data comes from

    We receive data:

    • from you: at registration, in your account settings, in projects, forms and messages,
    • from your employer's identity provider and user directory, where it has enabled single sign-on (SSO): e-mail address, first and last name, group memberships,
    • from a partner's system, where you use the planner in an organization it manages (e.g. a manufacturer, a distributor or a security-agency management system): e-mail address, first and last name, company name, tax ID, your identifier in the partner's system and your role, and for site projects the site's name, address and coordinates.

We process data related to your work in such an organization on behalf of the organization, which is its controller (e.g. your employer), under a data processing agreement (Article 28 GDPR). For questions about this data, contact the organization; we will help it fulfil your rights.

    Scope of processed data

The Controller may process the following personal data:

    • email address,
    • data provided via contact or registration forms,
    • data required to provide services and billing,
    • where your employer has enabled single sign-on: the identity attributes their identity provider asserts when you sign in (e-mail address, first and last name, group memberships), and the account records their directory sends us to create, update or deactivate your account,
    • where you use the planner in an organization managed by a partner (e.g. a manufacturer or distributor): the data the partner's system sends us when it grants access and signs you in (e-mail address, first and last name, company name, tax ID, your identifier in the partner's system), and a record of your activity in that organization (sign-ins, project changes, exports), which its owner and administrators can see,
    • technical data such as IP address, browser and device information (for security and analytics purposes).

Purposes and legal bases of processing

We process data for the following purposes and on the following legal bases:

    • providing the service (account, projects, teamwork, AI features you run): Article 6(1)(b) GDPR, performance of a contract,
    • answering enquiries and messages about your account and the service: Article 6(1)(b) GDPR, and before a contract is concluded Article 6(1)(f) GDPR (legitimate interest in answering the enquiry),
    • payments and billing: Article 6(1)(b) GDPR; invoices and accounting: Article 6(1)(c) GDPR, legal obligation,
    • security of the service and prevention of abuse (technical logs, request limits, the device limit): Article 6(1)(f) GDPR, legitimate interest,
    • our own statistics on how the service is used, and its development: Article 6(1)(f) GDPR, legitimate interest,
    • Google analytics and ad measurement (Google Analytics, Google Ads): Article 6(1)(a) GDPR, consent,
    • establishing, exercising and defending legal claims: Article 6(1)(f) GDPR, legitimate interest.

    Data recipients

Data may be shared with trusted service providers supporting the Controller in:

    • hosting,
    • IT services,
    • accounting,
    • payment processing,

only to the extent necessary to provide the services.

In particular, the Controller uses the following processors:

    • Supabase: application database, authentication and file storage (EU region),
    • Cloudflare: delivering and protecting the site (IP address and requests to the service),
    • Stripe: payment processing,
    • Resend: sending transactional email,
    • Anthropic: the AI assistant and AI planner, only when the user runs them (project description, question and attached files; never the site address or account data),
    • Google (Analytics, Ads): website analytics (only with your consent),
    • Google Public DNS, reading the DNS record that proves an organization owns its domain (the domain name only, no personal data),
    • LH.pl Sp. z o.o.: hosting of the website files (Poland).

When the user shows the map or searches for an address, the browser connects directly to map and address search providers (Google, Esri, Geoportal, OpenStreetMap Foundation, komoot, OpenFreeMap, Amazon Web Services, FOSSGIS). They receive the browser's IP address and the map area or the address typed, and process them as independent controllers under their own terms.

YouTube (Google) films load only when you press play, in YouTube's privacy-enhanced mode (youtube-nocookie.com); Google then receives the browser's IP address. When a PDF is exported with Arabic, Devanagari, Japanese, Korean or Thai script, the browser downloads the font it needs from Google Fonts, which also gives Google the IP address. All other fonts of the service are served from our own server.

Transfers outside the European Economic Area (EEA)

Core application data (accounts and projects) is stored on servers in the European Union. However, some of the processors above may process data outside the EEA:

    • Supabase: data stored in the EU, with service access by the provider from the United States and Singapore,
    • Stripe: payment processing (Ireland / United States),
    • Google (Analytics, Ads): analytics, only with your consent (United States),
    • Cloudflare: delivering and protecting the site (United States and its global network),
    • Anthropic: the AI assistant and AI planner, only when the user runs them (United States),
    • Resend: transactional email delivery (United States).

Transfers to Stripe, Google, Cloudflare and Resend rely on the European Commission's adequacy decision on the EU-U.S. Data Privacy Framework, and transfers to Anthropic and Supabase on the Standard Contractual Clauses (SCCs) adopted by the European Commission. You may request a copy of these safeguards at the contact address above.

    Cookies and analytics

The service uses cookies and similar local-storage technologies in two categories:

    • essential — required for the service to work (login session, security, and remembering your cookie choice); always active and not requiring consent,
    • analytics and advertising: Google Analytics and Google Ads, used to measure how the service is used and how our ads perform, and to tailor Google ads; these run only after you accept them, on the basis of your consent (Article 6(1)(a) GDPR).

You can accept or decline analytics and advertising cookies in the consent banner and change your choice at any time. Declining does not limit access to the service.

You can withdraw your consent at any time with the “Cookie Settings” button in the page footer or the button below. Withdrawal does not affect the lawfulness of processing before it. Once you withdraw it, we remove Google's cookies from your browser and stop loading Google's tags.

    Data retention period

    Personal data is retained:

    • for the duration of the agreement,
    • account data is deleted or anonymised within 30 days of account closure, unless longer retention is required by law,
    • billing and invoice records — for the period required by tax and accounting law (in Poland, 5 years from the end of the accounting year in which the transaction occurred),
    • attributes received from an identity provider are kept for as long as the account exists and are refreshed at every sign-in; deactivation by the directory ends access but does not by itself delete the account,
    • the activity record in a managed organization is kept until your account or the organization is deleted; withdrawal of access by the partner ends access but does not by itself delete the account or the record,
    • questions and answers of the AI features: the content 90 days, the entry itself without the content 12 months,
    • technical application error logs: 30 days, request-limit records: 1 hour, blocked-device records: 12 months,
    • an organization's event log (changes to members and access, SSO events, settings changes, administrators' views of projects): as long as an organization using SSO sets, otherwise 12 months,
    • sign-in history (device type, browser and system, no IP address), statistics on how the service is used and the history of changes to reviews of the service: 24 months,
    • until consent is withdrawn, where processing is based on consent.

    Data Protection Officer

The Controller has not appointed a Data Protection Officer, as it is not required under Article 37 GDPR. For all data-protection matters, please use the contact address given above.

    User rights

    Users have the right to:

    • access their personal data,
    • rectify data,
    • erase data,
    • restrict processing,
    • data portability,
    • object to processing,
    • withdraw consent at any time, without affecting the lawfulness of processing before the withdrawal,
    • lodge a complaint with the supervisory authority.

    Voluntary provision of data

Providing personal data is voluntary but necessary to use certain features of the service.

    Administrator danych osobowych

    Administratorem danych osobowych jest:

    DEFENSAR Aleksander Kubiak

    ul. Zamkowa 20A/21

    83-110 Tczew, Poland

    NIP/VAT: PL5562789202

    (dalej: „Administrator”).

    • od dostawcy tożsamości i katalogu użytkowników Twojego pracodawcy, gdy włączył on logowanie jednokrotne (SSO): adres e-mail, imię i nazwisko, przynależność do grup,

    Cele i podstawy prawne przetwarzania

Dane przetwarzamy w następujących celach i na następujących podstawach:

    • świadczenie usługi (konto, projekty, praca zespołowa, funkcje AI uruchamiane przez Ciebie): art. 6 ust. 1 lit. b RODO, wykonanie umowy,
    • odpowiedzi na zapytania i wiadomości o koncie i usłudze: art. 6 ust. 1 lit. b RODO, a przed zawarciem umowy art. 6 ust. 1 lit. f RODO (prawnie uzasadniony interes w odpowiedzi na zapytanie),
    • płatności i rozliczenia: art. 6 ust. 1 lit. b RODO; faktury i księgowość: art. 6 ust. 1 lit. c RODO, obowiązek prawny,
    • bezpieczeństwo serwisu i zapobieganie nadużyciom (logi techniczne, limity zapytań, limit urządzeń): art. 6 ust. 1 lit. f RODO, prawnie uzasadniony interes,
    • własne statystyki korzystania z serwisu i jego rozwój: art. 6 ust. 1 lit. f RODO, prawnie uzasadniony interes,
    • analityka i pomiar reklam Google (Google Analytics, Google Ads): art. 6 ust. 1 lit. a RODO, zgoda,
    • ustalenie, dochodzenie i obrona roszczeń: art. 6 ust. 1 lit. f RODO, prawnie uzasadniony interes.

    Odbiorcy danych

Dane mogą być przekazywane podmiotom wspierającym Administratora w zakresie:

    • hostingu,
    • obsługi IT,
    • księgowości,
    • systemów płatności,

wyłącznie w zakresie niezbędnym do realizacji usług.

W szczególności Administrator korzysta z następujących podmiotów przetwarzających:

    • Supabase: baza danych aplikacji, uwierzytelnianie i przechowywanie plików (region UE),
    • Cloudflare: dostarczanie i ochrona serwisu (adres IP i zapytania do serwisu),
    • Stripe: obsługa płatności,
    • Resend: wysyłka wiadomości transakcyjnych,
    • Anthropic: asystent AI i planer AI, wyłącznie gdy użytkownik sam je uruchomi (opis projektu, pytanie i dołączone pliki; nigdy adres obiektu ani dane konta),
    • Google (Analytics, Ads): analityka serwisu (wyłącznie za Twoją zgodą),
    • Google Public DNS, w zakresie odczytu rekordu DNS potwierdzającego, że organizacja jest właścicielem swojej domeny (wyłącznie nazwa domeny, bez danych osobowych),
    • LH.pl Sp. z o.o.: hosting plików serwisu (Polska).

Gdy użytkownik wyświetla mapę albo szuka adresu, przeglądarka łączy się bezpośrednio z dostawcami map i wyszukiwania adresów (Google, Esri, Geoportal, OpenStreetMap Foundation, komoot, OpenFreeMap, Amazon Web Services, FOSSGIS). Otrzymują oni adres IP przeglądarki oraz obszar mapy albo wpisany adres i przetwarzają je jako niezależni administratorzy na podstawie własnych zasad.

Filmy z YouTube (Google) wczytujemy dopiero po kliknięciu odtwarzania, w trybie rozszerzonej prywatności YouTube (youtube-nocookie.com); wtedy Google otrzymuje adres IP przeglądarki.

Przekazywanie danych poza Europejski Obszar Gospodarczy (EOG)

    • Supabase: dane przechowywane w UE, z dostępem serwisowym dostawcy z USA i Singapuru,
    • Stripe: obsługa płatności (Irlandia / Stany Zjednoczone),
    • Google (Analytics, Ads): analityka, wyłącznie za Twoją zgodą (Stany Zjednoczone),
    • Cloudflare: dostarczanie i ochrona serwisu (Stany Zjednoczone i sieć globalna),
    • Anthropic: asystent AI i planer AI, wyłącznie gdy użytkownik sam je uruchomi (Stany Zjednoczone),
    • Resend: dostarczanie wiadomości transakcyjnych (Stany Zjednoczone).

Podstawą przekazania jest dla Stripe, Google, Cloudflare i Resend decyzja Komisji Europejskiej stwierdzająca odpowiedni stopień ochrony w ramach Ram Ochrony Danych UE-USA (Data Privacy Framework), a dla Anthropic i Supabase standardowe klauzule umowne (SCC) przyjęte przez Komisję Europejską. Kopię tych zabezpieczeń możesz uzyskać pod adresem kontaktowym podanym powyżej.

    Pliki cookie i analityka

Serwis wykorzystuje pliki cookie oraz podobne technologie pamięci lokalnej w dwóch kategoriach:

    • niezbędne — konieczne do działania serwisu (sesja logowania, bezpieczeństwo oraz zapamiętanie Twojego wyboru dotyczącego cookie); zawsze aktywne i niewymagające zgody,
    • analityczne i reklamowe: Google Analytics i Google Ads, służące do pomiaru sposobu korzystania z serwisu i skuteczności naszych reklam oraz do dopasowania reklam Google; uruchamiane wyłącznie po ich zaakceptowaniu, na podstawie Twojej zgody (art. 6 ust. 1 lit. a RODO).

    • pytania i odpowiedzi funkcji AI: treść 90 dni, sam wpis bez treści 12 miesięcy,
    • logi techniczne błędów aplikacji: 30 dni, zapisy limitów zapytań: 1 godzinę, zapisy zablokowanych urządzeń: 12 miesięcy,
    • dziennik zdarzeń organizacji (zmiany członków i dostępu, zdarzenia SSO, zmiany ustawień, podgląd projektów przez administratorów): tyle, ile ustawi organizacja korzystająca z SSO, w pozostałych przypadkach 12 miesięcy,
    • historia logowań (rodzaj urządzenia, przeglądarka i system, bez adresu IP), statystyki korzystania z serwisu i historia zmian opinii o serwisie: 24 miesiące,

37 RODO. We wszystkich sprawach dotyczących ochrony danych prosimy o kontakt pod adresem podanym powyżej.

    Prawa użytkownika

    Użytkownik ma prawo do:

    • dostępu do swoich danych,
    • ich sprostowania,
    • usunięcia,
    • ograniczenia przetwarzania,
    • przenoszenia danych,
    • wniesienia sprzeciwu wobec przetwarzania,
    • cofnięcia zgody w dowolnym momencie, bez wpływu na zgodność z prawem przetwarzania przed jej cofnięciem,
    • wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych.

    Dobrowolność podania danych

Podanie danych osobowych jest dobrowolne, jednak niezbędne do korzystania z wybranych funkcji serwisu.
